MEDICAL NEGLIGENCE

Medical negligence refers to a situation where a healthcare professional fails to provide the standard of care that is expected in their field, resulting in harm or injury to a patient. This can occur due to various reasons, such as misdiagnosis, surgical errors, improper treatment, failure to inform a patient about the risks of a procedure, and discrimination due to race, age, marital status, ethnicity, gender, nationality, etc.

To establish a case of medical negligence, the following elements typically need to be proven:

  • Duty of care – the healthcare provider had a duty of care for the patient;
  • Breach of duty – the provider failed to meet the standard of care expected;
  • Causation – the breach of duty directly caused harm or injury to the patient;
  • Damages – the patient suffered actual damages, such as physical injury, emotional distress, or financial loss.

It is important to gather as much evidence as possible to support a case of medical negligence.
